These Terms of Service (the "Terms") govern your use of the Puzzlock service at puzzlock.app, operated by Flow Through Logic Pty Ltd (ABN 15 697 017 842, ACN 697 017 842) ("Puzzlock", "we", "us", or "our").
By creating an account or otherwise using the service, you agree to these Terms. "You" means the person doing so.
1. The service
Puzzlock is a cognitive-puzzle game in limited founder beta. The service comprises short puzzles, skill ratings across ten cognitive constructs, achievements, leaderboards, and time-boxed tournaments. No paid tier is offered and no payment information is collected during the beta.
2. Accounts
2.1 Founder access
Registration is open during the founder beta, capped at the founder cohort size displayed on the signup page. Once the cap is reached, signups continue under an Early Access tier without the founder title. Referral links from existing members provide attribution but are not required to register.
2.2 Sign-up
To register for an account, you must:
- be 13 years of age or older; if you are under 13, you are not permitted to use Puzzlock;
- provide a valid email address and choose a password, a display name, and a username; and
- keep your password confidential.
You are responsible for all activity that occurs under your account. Do not share your credentials.
2.3 One account per person
One natural person may hold one account. Multiple accounts created to manipulate achievements, skill ratings, or tournament outcomes will be merged or removed.
3. Acceptable use
You must not:
- use bots, scripts, automation, emulators, or modified clients to play puzzles or earn ratings or achievements;
- scrape, mirror, or systematically extract data from the service (including leaderboards, profile pages, and the API) beyond ordinary gameplay;
- reverse-engineer, deobfuscate, or probe the service for security weaknesses, except through a good-faith responsible-disclosure report to [email protected];
- interfere with the rating or tournament systems (including by sharing daily puzzle answers before the daily window has closed, deliberately submitting tournament runs designed to manipulate standings, or coordinating with others to inflate or sabotage scores);
- harass, threaten, impersonate, or bully other players through your display name, username, or any other visible field;
- submit content (including display names, usernames, feedback, and waitlist explanations) that is unlawful, infringing, obscene, hateful, or designed to harm another person; or
- use the service in a way that breaches any law of Australia, the law of the jurisdiction you are in, or the law of any jurisdiction where the content is reasonably expected to be seen.
We may throttle, suspend, or permanently terminate access where we reasonably believe the above has been breached.
4. Your content, and the licence you grant us
4.1 Profile content
When you choose a display name or username, submit a waitlist explanation, or have scores, achievements, or a title displayed publicly, you retain ownership of that content.
You grant us a non-exclusive, worldwide, royalty-free licence to display your username, display name, equipped title, skill ratings, achievements, high score, friend count, and tournament results on your public profile page, on leaderboards, and on the OG image cards generated for share links.
This licence ends when you delete the relevant content (for example, by changing your display name, unequipping a title, or deleting your account), other than in respect of back-ups or content already used publicly before the deletion.
4.2 Feedback, suggestions, and ideas
Any feedback, suggestion, bug report, feature request, idea, or improvement that you provide to us, through any channel (including the in-service feedback form, email, or a social platform), is treated as non-confidential and non-proprietary.
You grant us a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, sublicensable, and transferable licence to use, copy, modify, create derivative works of, publish, display, distribute, commercialise, and otherwise exploit that feedback, in whole or in part, in any form and for any purpose, without any obligation to credit or compensate you or to obtain your further consent.
You warrant that the feedback is either original to you or that you are otherwise entitled to grant the licence above, and you waive any moral rights in the feedback to the extent permitted by law.
Where we release a feature of the service that resembles an idea you have provided, you have no claim to payment, equity, royalty, attribution, or other consideration, whether or not the feature was in fact influenced by your idea and whether or not the feature is subsequently monetised.
Nothing in this clause restricts your ability to use or disclose your idea elsewhere.
5. Our content
The code, design, puzzle content, visual identity, copy, and other materials produced by us are owned by us (or licensed to us) and are protected by copyright, trade-mark rights, and related intellectual-property rights. You may not copy, redistribute, or prepare derivative works of any of it without our prior written permission, save for ordinary dealings permitted by law (including fair dealing or fair use, interoperability, and personal back-up).
6. Beta status
The service is in limited founder beta. In particular:
- features may change, break, or be removed without notice;
- skill ratings, achievements, leaderboards, and tournaments may be reset at any time;
- data may be lost, duplicated, or corrupted during deployments;
- no service-level, uptime, or response-time commitment applies; and
- tournament windows, rewards, and titles may change.
7. Privacy
The personal information we collect and how we handle it is described in the Privacy Policy, which forms part of these Terms.
8. Termination
8.1 Termination by you
You may terminate your account at any time, either through the in-service "Delete account" function on the settings page or by emailing [email protected] from the email address associated with your account. Records keyed to your user ID are removed within 30 days in accordance with §6 of the Privacy Policy.
8.2 Termination by us
We may suspend or terminate your account, with or without notice, where:
- we reasonably believe you have breached §3 (Acceptable use);
- we are required to do so by law, a court order, or a regulatory authority; or
- continuing to operate the service, or to provide it to you, has become commercially or technically impracticable (including where we discontinue the beta).
Where termination is due to discontinuation of the service rather than conduct by you, we will give reasonable notice and a reasonable opportunity for you to export your data.
9. Disclaimers
Subject to §10, the service is provided on an "as is" and "as available" basis. We do not warrant that the service will be error-free, uninterrupted, or fit for any particular purpose.
Puzzlock is a game, not a psychometric or diagnostic tool. Skill ratings, construct fingerprints, and mastery tiers are measures of your performance within the Puzzlock environment. They are not, and must not be relied upon as, an intelligence test, neuropsychological assessment, or clinical evaluation. Puzzlock results must not be used to diagnose, hire, enrol, exclude, or make any material decision about any person.
10. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded or limited.
11. Limitation of liability
To the maximum extent permitted by law, and subject to §10:
- Indirect loss. We are not liable for any indirect, consequential, special, punitive, or incidental loss, or for any loss of profits, goodwill, data, revenue, or opportunity, arising out of or in connection with the service.
- Aggregate cap. Where our liability may be limited, but not excluded, under the Australian Consumer Law or any equivalent law, our total aggregate liability in respect of all claims arising out of or in connection with the service is limited, at our election, to re-supplying the service or paying the cost of re-supplying the service.
12. Indemnity
You indemnify us against any reasonable legal costs, damages, or settlement payments we incur as a result of a third-party claim arising out of your breach of these Terms, including claims arising from your conduct toward other players or from your infringement of a third party's rights. This indemnity does not apply to the extent a loss is caused or contributed to by us.
13. Governing law and jurisdiction
These Terms are governed by the laws of the Australian Capital Territory and the Commonwealth of Australia.
The parties submit to the non-exclusive jurisdiction of the courts of the Australian Capital Territory and any courts entitled to hear appeals from them.
Before commencing court proceedings, each party will use reasonable efforts to resolve the dispute in good faith. Initial notice should be sent to [email protected].
14. Changes to these Terms
These Terms may be updated from time to time. The "Effective" date at the top of this document reflects the date of the most recent version. Where a change materially affects your rights, we will notify registered users by email before the change takes effect. Continued use of the service after a change takes effect constitutes acceptance of the updated Terms. If you do not accept an update, you may terminate your account under §8.1.
15. General
- Severability. If any provision of these Terms is held to be unenforceable, the remainder of the Terms continues in force.
- No waiver. A failure to enforce any provision does not constitute a waiver of that provision.
- Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a corporate transaction (such as a sale, merger, or restructure of the business).
- Entire agreement. These Terms, together with the Privacy Policy and the Cookie Policy, constitute the entire agreement between you and us in relation to the service.
